DECISION OF THE EEA JOINT COMMITTEE
No 77/2017
of 5 May 2017
amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2019/189]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

(1) |
Commission Implementing Regulation (EU) 2017/173 of 1 February 2017 amending Regulation (EC) No 1292/2008 and Implementing Regulation (EU) No 887/2011, as regards the name of the holder of the authorisation of Bacillus amyloliquefaciens CECT 5940 and Enterococcus faecium CECT 4515 (1) is to be incorporated into the EEA Agreement. |

(2) |
Commission Implementing Regulation (EU) 2017/187 of 2 February 2017 concerning the authorisation of a preparation of Bacillus subtilis (DSM 28343) as a feed additive for chickens for fattening (holder of authorisation Lactosan GmbH & Co. KG) (2) is to be incorporated into the EEA Agreement. |

Commission Implementing Regulation (EU) 2017/194 of 3 February 2017 concerning the authorisation of the preparation of Lactobacillus diolivorans DSM 32074 as a feed additive for all animal species (3) is to be incorporated into the EEA Agreement. |

Commission Implementing Regulation (EU) 2017/210 of 7 February 2017 concerning the authorisation of a preparation of endo-1,4-beta-xylanase and endo-1,3(4)-beta-glucanase produced by Talaromyces versatilis sp. nov. IMI CC 378536 and Talaromyces versatilis sp. nov. DSM 26702 as a feed additive for laying hens (holder of the authorisation Adisseo France S.A.S.) (4) is to be incorporated into the EEA Agreement. |

Commission Implementing Regulation (EU) 2017/211 of 7 February 2017 concerning the authorisation of a preparation of endo-1,4-beta-xylanase (EC 3.2.1.8) produced by Bacillus subtilis (LMG-S 15136) as a feed additive for poultry, weaned piglets and pigs for fattening, and amending Regulations (EC) No 1259/2004, (EC) No 1206/2005, and (EC) No 322/2009 and repealing Regulation (EC) No 516/2007 (holder of authorisation Beldem, a division of Puratos NV) (5) is to be incorporated into the EEA Agreement. |

Commission Implementing Regulation (EU) 2017/219 of 8 February 2017 concerning the authorisation of a preparation of Bacillus subtilis (DSM 27273) as a feed additive for weaned piglets and weaned minor porcine species (holder of authorisation Chr. Hansen A/S) (6) is to be incorporated into the EEA Agreement. |

Implementing Regulation (EU) 2017/211 repeals Regulation (EC) No 516/2007 (7) which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement. |

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein. |

Annex I to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The following indent is added in points 1zs (Commission Regulation (EC) No 1259/2004), 1zzn (Commission Regulation (EC) No 1206/2005) and 1zzzzx (Commission Regulation (EC) No 322/2009):

The following points are inserted after point 189 (Commission Implementing Regulation (EU) 2017/66):

3. |
The text of point 1zzzq (Commission Regulation (EC) No 516/2007) is deleted. |
Article 2
The texts of Implementing Regulations (EU) 2017/173, (EU) No 2017/187, (EU) 2017/194, (EU) 2017/210, (EU) 2017/211 and (EU) 2017/219 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 6 May 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
