The Open Data Directive, Data Governance and Data Act and their possible impact on research

Discover the European Commission’s Directorate-General for Research and Innovation’s new study

 

On 1 August 2022, the European Commission’s Directorate-General for Research and Innovation published a study titled ‘Study on the Open Data Directive, Data Governance and Data Act and their possible impact on research’. In the study, the authors focused on the possible impact that three major legislative instruments in the European Strategy for data (the Open Data Directive, the Data Governance Act, and the proposed Data Act) may have in the field of research, especially regarding research performing organisations and research funding institutions.

The study recognises that the impact the three legislative instruments have on research is currently limited as the Data Governance Act was recently approved and still needs to be implemented, while the Data Act is still in its proposal phase. They also note that several key legal issues need to be resolved going forward. These issues relate to the ambiguities in the scope of the application to research data, the interpretation of provisions, and the consistency between the instruments that use open science research policy.
