amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 123/2002 of 27 September 2002(1).

(2) Council Directive 98/95/EC of 14 December 1998 amending, in respect of the consolidation of the internal market, genetically modified plant varieties and plant genetic resources, Directives 66/400/EEC, 66/401/EEC, 66/402/EEC, 66/403/EEC, 69/208/EEC, 70/457/EEC and 70/458/EEC on the marketing of beet seed, fodder plant seed, cereal seed, seed potatoes, seed of oil and fibre plants and vegetable seed and on the common catalogue of varieties of agricultural plant species(2), as corrected by OJ L 126, 20.5.1999, p. 23, OJ L 161, 16.6.2001, p. 47 and OJ L 82, 26.3.2002, p. 20, is to be incorporated into the Agreement.

(3) Council Directive 98/96/EC of 14 December 1998 amending, inter alia, as regards unofficial field inspections under Directives 66/400/EEC, 66/401/EEC, 66/402/EEC, 66/403/EEC, 69/208/EEC, 70/457/EEC and 70/458/EEC on the marketing of beet seed, fodder plant seed, cereal seed, seed potatoes, seed of oil and fibre plants and vegetable seed and on the common catalogue of varieties of agricultural plant species(3), as corrected by OJ L 161, 16.6.2001, p. 48, is to be incorporated into the Agreement.

(4) Commission Regulation (EC) No 930/2000 of 4 May 2000 establishing implementing rules as to the suitability of the denominations of varieties of agricultural plant species and vegetable species(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter III of Annex I to the Agreement shall be amended as follows.

1. In Part 1, the following indents shall be added in points 1 (Council Directive 66/400/EEC), 2 (Council Directive 66/401/EEC), 3 (Council Directive 66/402/EEC) and 4 (Council Directive 69/208/EEC):

"- 398 L 0095: Council Directive 98/95/EC of 14 December 1998 (OJ L 25, 1.2.1999, p. 1), as corrected by OJ L 126, 20.5.1999, p. 23, OJ L 161, 16.6.2001, p. 47 and OJ L 82, 26.3.2002, p. 20,

- 398 L 0096: Council Directive 98/96/EC of 14 December 1998 (OJ L 25, 1.2.1999, p. 27), as corrected by OJ L 161, 16.6.2001, p. 48."

2. In Part 1, the following shall be added before the adaptation text in point 5 (Council Directive 70/457/EEC):

"- 398 L 0095: Council Directive 98/95/EC of 14 December 1998 (OJ L 25, 1.2.1999, p. 1), as corrected by OJ L 126, 20.5.1999, p. 23, OJ L 161, 16.6.2001, p. 47 and OJ L 82, 26.3.2002, p. 20,

- 398 L 0096: Council Directive 98/96/EC of 14 December 1998 (OJ L 25, 1.2.1999, p. 27), as corrected by OJ L 161, 16.6.2001, p. 48.

The provisions of the Directive shall, for the purposes for the present Agreement, be read with the following adaptation:

References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement."

3. In Part 1, the following shall be added in point 6 (Council Directive 70/458/EEC):

"- 398 L 0095: Council Directive 98/95/EC of 14 December 1998 (OJ L 25, 1.2.1999, p. 1), as corrected by OJ L 126, 20.5.1999, p. 23, OJ L 161, 16.6.2001, p. 47 and OJ L 82, 26.3.2002, p. 20,

- 398 L 0096: Council Directive 98/96/EC of 14 December 1998 (OJ L 25, 1.2.1999, p. 27), as corrected by OJ L 161, 16.6.2001, p. 48.

The provisions of the Directive shall, for the purposes for the present Agreement, be read with the following adaptation:

References to other acts in the Directive shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement."

4. In Part 2, the following point shall be inserted after point 17 (Commission Decision 2002/98/EC):

"18. 32000 R 0930: Commission Regulation (EC) No 930/2000 of 4 May 2000 establishing implementing rules as to the suitability of the denominations of varieties of agricultural plant species and vegetable species (OJ L 108, 5.5.2000, p. 3).

The provisions of the Regulation shall, for the purposes for the present Agreement, be read with the following adaptation:

References to other acts in the Regulation shall be considered relevant to the extent and in the form that those acts are incorporated into the Agreement."

Article 2

The texts of Directive 98/95/EC, as corrected by OJ L 126, 20.5.1999, p. 23, OJ L 161, 16.6.2001, p. 47 and OJ L 82, 26.3.2002, p. 20, and Directive 98/96/EC, as corrected by OJ L 161, 16.6.2001, p. 48, and Regulation (EC) No 930/2000 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 December 2002 provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Union.
