No 159/2002

of 6 December 2002

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 138/2002 of 8 November 2002(1).

(2) Directive 2002/24/EC of the European Parliament and of the Council of 18 March 2002 relating to the type-approval of two or three-wheel motor vehicles and repealing Council Directive 92/61/EEC(2) is to be incorporated into the Agreement.

(3) Directive 2002/24/EC repeals, with effect from 9 November 2003, Directive 92/61/EEC, which is incorporated into the Agreement, and which is consequently to be repealed under the Agreement.

(4) Directive 2000/7/EC of the European Parliament and of the Council(3), which is already incorporated into the Agreement, needs to be moved to a separate point in Chapter I of Annex II to the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex II to the Agreement shall be amended as follows.

1. The text of point 45f (Council Directive 92/61/EEC) shall be deleted with effect from 9 November 2003.

2. The following points shall be inserted after point 45y (Directive 2001/85/EC of the European Parliament and of the Council):

"45z. 32000 L 0007: Directive 2000/7/EC of the European Parliament and of the Council of 20 March 2000 on speedometers for two- or three-wheel motor vehicles and amending Council Directive 92/61/EEC on the type-approval of two- or three-wheel motor vehicles (OJ L 106, 3.5.2000, p. 1).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptations:

(a) in Annex IV, Part A, the following shall be added to paragraph 47:

'Iceland:...'

'Liechtenstein: ...'

'Norway:...';

(b) in Annex V, Part B, the following shall be added to paragraph 1.1:

'- IS for Iceland:...'

'- FL for Liechtenstein: ...'

'- 16 for Norway:...'.

"

Article 2

The text of Directive 2002/24/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 7 December 2002 provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(4).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Union.
