amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 27/2002 of the EEA Joint Committee of 19 April 2002(1).

(2) Directive 2001/56/EC of the European Parliament and of the Council of 27 September 2001 relating to heating systems for motor vehicles and their trailers, amending Council Directive 70/156/EEC and repealing Council Directive 78/548/EEC(2) is to be incorporated into the Agreement.

(3) Commission Directive 2001/92/EC of 30 October 2001 adapting to technical progress Council Directive 92/22/EEC on safety glazing and glazing materials on motor vehicles and their trailers and Council Directive 70/156/EEC relating to the type-approval of motor vehicles and their trailers(3) is to be incorporated into the Agreement.

(4) Directive 2001/56/EC repeals, with effect from 9 May 2004, Directive 78/548/EEC of 12 June 1978 (OJ L 168, 26.6.1978, p. 40), which is incorporated in the Agreement and which is consequently to be repealed under the Agreement.

(5) The adaptations to Council Directive 70/156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers (OJ L 42, 23.2.1970, p. 1) made pursuant to Chapter XI of Annex I to the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded(4) are to be incorporated into the Agreement.

(6) The adaptations in the Agreement to Council Directive 70/156/EEC need to be adjusted following the accession of Austria, Finland and Sweden to the European Union,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex II to the Agreement shall be amended as follows:

1. in point 1 (Council Directive 70/156/EEC), the following indents shall be added: "- 1 94 N: Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded (OJ C 241, 29.8.1994, p. 21, as adjusted by OJ L 1, 1.1.1995, p. 1),

- 32001 L 0056: Directive 2001/56/EC of the European Parliament and of the Council of 27 September 2001 (OJ L 292, 9.11.2001, p. 21),

- 32001 L 0092: Commission Directive 2001/92/EC of 30 October 2001 (OJ L 291, 8.11.2001, p. 24).";

2. in point 1 (Council Directive 70/156/EEC), the adaptation text shall be replaced by the following: "(a) In Article 2(a), the following indents shall be added:

- 'gerðarviðurkenning' in Icelandic law,

- 'Typengenehmigung' in Liechtenstein law,

- 'typegodkjenning' in Norwegian law.

(b) In Annex I, the following shall be added to point 1.1.1 of Appendix 5: 'IS for Iceland

FL for Liechtenstein

16 for Norway'.

(c) In Annex VII, the following shall be added to point 1, section 1: 'IS for Iceland

FL for Liechtenstein

16 for Norway'.

(d) In Annex IX, the following shall be added to points 37 of parts I and II: 'Iceland: ...,

Liechtenstein: ...,

Norway: ...'

";

3. the text of point 37 (Council Directive 78/548/EEC) shall be deleted with effect from 9 May 2004;

4. the following shall be added in point 45c (Council Directive 92/22/EEC): ", as amended by:

- 32001 L 0092: Commission Directive 2001/92/EC of 30 October 2001 (OJ L 291, 8.11.2001, p. 24)."

Article 2

The texts of Directives 2001/56/EC and 2001/92/EC and of the adaptations to Directive 70/156/EEC made pursuant to Chapter XI of Annex I to the Act concerning the conditions of accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden and the adjustments of the Treaties on which the European Union is founded in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 1 June 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 4

This Decision shall be published in the EEA section of, and in the EEA Supplement to, the Official Journal of the European Communities.
