DECISION OF THE EEA JOINT COMMITTEE

No 2/2007

of 27 April 2007

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 141/2006 of 8 December 2006 (1).

(2)

Commission Decision 2003/724/EC of 10 October 2003 granting a temporary derogation from Directive 82/894/EEC as regards the frequency of notification of primary outbreaks of bovine spongiform encephalopathy (2) is to be incorporated into the Agreement.

(3)

Commission Decision 2004/216/EC of 1 March 2004 amending Council Directive 82/894/EEC on the notification of animal diseases within the Community to include certain equine diseases and certain diseases of bees to the list of notifiable diseases (3) is to be incorporated into the Agreement.

(4)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as follows:

1.

the following indent shall be added in point 10 (Council Directive 82/894/EEC) in Part 3.1:

‘—

32004 D 0216: Commission Decision 2004/216/EC of 1 March 2004 (OJ L 67, 5.3.2004, p. 27).’;

2.

the following adaptation text shall be inserted in point 10 (Council Directive 82/894/EEC) in Part 3.1:

‘The provisions of the Directive shall, for the purpose of this Agreement, be read with the following adaptation:

This act applies also to Iceland.’;

3.

the following point shall be inserted after point 33 (Commission Decision 2005/393/EC) in Part 3.2:

‘34.

32003 D 0724: Commission Decision 2003/724/EC of 10 October 2003 granting a temporary derogation from Directive 82/894/EEC as regards the frequency of notification of primary outbreaks of bovine spongiform encephalopathy (OJ L 260, 11.10.2003, p. 36).’

Article 2

The texts of Decisions 2003/724/EC and 2004/216/EC in the Icelandic and Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 28 April 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
