DECISION OF THE EEA JOINT COMMITTEE

No 41/2007

of 27 April 2007

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 147/2006 of 8 December 2006 (1).

(2)

Commission Regulation (EC) No 1609/2006 of 27 October 2006 authorising the placing on the market of infant formulae based on hydrolysates of whey protein derived from cows' milk protein for a two-year period (2) is to be incorporated into the Agreement.

(3)

Commission Directive 2006/92/EC of 9 November 2006 amending Annexes to Council Directives 76/895/EEC, 86/362/EEC and 90/642/EEC as regards maximum residue levels for captan, dichlorvos, ethion and folpet (3) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XII of Annex II to the Agreement shall be amended as follows:

1.

the following indent shall be added in points 13 (Council Directive 76/895/EEC), 38 (Council Directive 86/362/EEC) and 54 (Council Directive 90/642/EEC):

‘—

32006 L 0092: Commission Directive 2006/92/EC of 9 November 2006 (OJ L 311, 10.11.2006, p. 31).’;

2.

the following point shall be inserted after point 54zzy (Regulation (EC) No 396/2005 of the European Parliament and of the Council):

‘54zzz.

32006 R 1609: Commission Regulation (EC) No 1609/2006 of 27 October 2006 authorising the placing on the market of infant formulae based on hydrolysates of whey protein derived from cows’ milk protein for a two-year period (OJ L 299, 28.10.2006, p. 9.).’

Article 2

The texts of Regulation (EC) No 1609/2006 and Directive 2006/92/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 28 April 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (4).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
