DECISION OF THE EEA JOINT COMMITTEE

No 162/2014

of 25 September 2014

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2015/1230]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision 2014/90/EU of 14 February 2014 amending Annex I to Decision 2004/558/EC as regards the approval of a control programme for eradicating infectious bovine rhinotracheitis in a region in Italy (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision 2014/91/EU of 14 February 2014 amending Annex II to Decision 93/52/EEC as regards the recognition of certain regions of Italy and Spain as officially free of brucellosis (B. melitensis) and amending Annexes I, II and III to Decision 2003/467/EC as regards the declaration of Hungary as officially tuberculosis-free, Romania and certain regions of Italy as officially brucellosis-free, and certain regions of Italy as officially enzootic-bovine-leukosis-free (2) is to be incorporated into the EEA Agreement.

Commission Implementing Decision 2014/177/EU of 27 March 2014 amending Annex II to Decision 2003/467/EC as regards the declaration of Lithuania as officially brucellosis-free (3) is to be incorporated into the EEA Agreement.

(4)

This Decision concerns legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland.

(5)

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Part 4.2 of Chapter I of Annex I to the EEA Agreement shall be amended as follows:

(1)

the following indent is added in point 14 (Commission Decision 93/52/EEC):

‘—

32014 D 0091: Commission Implementing Decision 2014/91/EU of 14 February 2014 (OJ L 46, 18.2.2014, p. 12).’;

(2)

the following indents are added in point 70 (Commission Decision 2003/467/EC):

‘—

32014 D 0091: Commission Implementing Decision 2014/91/EU of 14 February 2014 (OJ L 46, 18.2.2014, p. 12),

32014 D 0177: Commission Implementing Decision 2014/177/EU of 27 March 2014 (OJ L 95, 29.3.2014, p. 45).’;

(3)

the following indent is added in point 80 (Commission Decision 2004/558/EC):

‘—

32014 D 0090: Commission Implementing Decision 2014/90/EU of 14 February 2014 (OJ L 46, 18.2.2014, p. 10).’

Article 2

The texts of Implementing Decisions 2014/90/EU, 2014/91/EU and 2014/177/EU in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 26 September 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
