DECISION OF THE EEA JOINT COMMITTEE No 3/2021

of 5 February 2021

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/25]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2020/687 of 17 December 2019 supplementing Regulation (EU) 2016/429 of the European Parliament and the Council, as regards rules for the prevention and control of certain listed diseases (1) is to be incorporated into the EEA Agreement.

(2)

Commission Delegated Regulation (EU) 2020/692 of 30 January 2020 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council as regards rules for entry into the Union, and the movement and handling after entry of consignments of certain animals, germinal products and products of animal origin (2) is to be incorporated into the EEA Agreement.

Delegated Regulation (EU) 2020/687 repeals, with effect from 21 April 2021, Council Directives 92/66/EEC (3), 2001/89/EC (4), 2003/85/EC (5) and 2005/94/EC (6), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement with effect from 21 April 2021.

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the EEA Agreement shall be amended as follows:

The following points are inserted after point 13d (Commission Implementing Regulation (EU) 2020/999) in Part 1.1:

‘13e.

32020 R 0687: Commission Delegated Regulation (EU) 2020/687 of 17 December 2019 supplementing Regulation (EU) 2016/429 of the European Parliament and the Council, as regards rules for the prevention and control of certain listed diseases (OJ L 174, 3.6.2020, p. 64).

This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part.

This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part.’

The texts of points 1a (Council Directive 2003/85/EC), 3 (Council Directive 2001/89/EC), 5a (Council Directive 2005/94/EC) and 6 (Council Directive 92/66/EEC) in Part 3.1, shall be deleted with effect from 21 April 2021.

Article 2

The texts of Delegated Regulations (EU) 2020/687 and (EU) 2020/692 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 6 February 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 179/2020 of 11 December 2020 (7), whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
