COMMISSION IMPLEMENTING DECISION (EU) 2023/1562

of 27 July 2023

amending Implementing Decision (EU) 2016/2323 establishing the European List of ship recycling facilities pursuant to Regulation (EU) No 1257/2013 of the European Parliament and of the Council

(Text with EEA relevance)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1257/2013 of the European Parliament and of the Council of 20 November 2013 on ship recycling and amending Regulation (EC) No 1013/2006 and Directive 2009/16/EC (1), and in particular Article 16 thereof,

Whereas:

Article 6(2), point (a), of Regulation (EU) No 1257/2013 requires ship owners to ensure that ships destined to be recycled are only recycled at ship recycling facilities included in the European List of ship recycling facilities (‘European List’) published pursuant to Article 16(2) of that Regulation.

The European List is set out in Commission Implementing Decision (EU) 2016/2323 (2).

The authorisation of San Giorgio del Porto S.p.A., a ship recycling facility located in Italy, expired on 6 June 2023. The authorisation of Modern American Recycling Services Europe (M.A.R.S. Europe) and Fayard A/S, ship recycling facilities located in Denmark, expired respectively on 23 August 2023 and 7 November 2023. The Commission has received information from Italy and Denmark that the authorisations granted to those facilities to conduct ship recycling have been renewed prior to their expiry, in accordance with Article 14 of Regulation (EU) No 1257/2013. Furthermore, Denmark informed the Commission of changes concerning the maximum ship dimensions accepted by M.A.R.S. Europe and its maximum annual ship recycling output and concerning the maximum annual ship recycling output of Fayard A/S. The European List should therefore be updated accordingly.

The Commission has received three applications, in accordance with Article 15(1) of Regulation (EU) No 1257/2013, for Anadolu Gemi Söküm Orman Ürn. Gida Tur. Nak, San. Ve Tic. A.Ş., BMS Gemi Geri Dönüşüm San Ve Tic. A.Ş. and Kiliçlar Geri Dönüşümlü Maddeler Ve Metal San.Tic A.Ş., ship recycling facilities located in Türkiye, to be included in the European List. Having assessed the information and supporting evidence provided and gathered in accordance with Article 15 of that Regulation, the Commission considers that the facilities comply with the requirements set out in Article 13 of that Regulation to conduct ship recycling and to be included in the European List. The European List should therefore be updated to include those facilities.

The Commission has been informed of changes in the contact details of Dales Marine Services Ltd, a ship recycling facility located in the United Kingdom. The European List should therefore be updated accordingly.

(6)

Implementing Decision (EU) 2016/2323 should therefore be amended accordingly.

The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 25 of Regulation (EU) No 1257/2013,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Implementing Decision (EU) 2016/2323 is replaced by the text in the Annex to this Decision.

Article 2

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

The U.S. Toxic Substances Control Act prohibits the import into the US of foreign flagged vessels that contain PCB concentrations greater than 50 parts per million.

The facility has two slips with ramps for final vessel recycling (East Slip and West Slip). Ships flying a flag of EU Member States shall be recycled exclusively on the East Slip ramp.

There is currently no procedure in US law related to the approval of ship recycling plans
