THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive (EU) 2016/797 of the European Parliament and of the Council of 11 May 2016 on the interoperability of the rail system within the European Union (1), and in particular Article 5(11) thereof,

The Bulgarian, German, Polish, Portuguese and Slovenian language versions of Commission Regulation (EU) No 1303/2014 (2) contain errors in the definition of ‘railway tunnel’ laid down in Section 2.4, point (a), of the Annex thereto, which hamper the correct interpretation of the term.

(2)

The Bulgarian, German, Polish, Portuguese and Slovenian language versions of Regulation (EU) No 1303/2014 should therefore be corrected accordingly. The other language versions are not affected.

(3)

The measures provided for in this Regulation are in accordance with the opinion of the Committee referred to in Article 29(1) of Directive 2008/57/EC of the European Parliament and of the Council (3), delivered prior to the adoption of Regulation (EU) No 1303/2014,

HAS ADOPTED THIS REGULATION:
